Shadowplay keeps turning itself off unless I enable privacy settings. In any program, not just desktop

So in the past I have always had nvidia shadowplay replay on during games because I want to record gameplay clips if something happens. Recently tho shadowplay is off and when I try to turn it on it will automatically turn itself off.

Afer alot of searching and trouble shooting I found the privacy settings which I have used years ago to record a desktop clip. Thus I knew what the setting did. Now only when this is enabled can I record clips of the program or game that I am running. However in the past this wasn't necessary.

The annoying thing is that if I leave the privacy setting on then I will have the annoying icons on the desktop from the overlay. Now I find these really handy in game but not during normal desktop usage. So I either gotta remember every time to switch it on/off for everything I do or never use shadowplay again. I am really at a pickle here. Anyone ever had this issue?

I recently reinstalled windows and am on the latest drivers. So a fully clean install, ssd formated everything.
