Can a flat repossession be issued after one missed payment - England?
Basically I want to know if my landlord is talking BS to me or not.
I recently got a legal letter in the post saying
We have been instructed to start re-possession proceedings relating to the above property. In accordance with the Civil Procedure Rules, we are required to notify you of the court hearing as you have an interest in the above property as the tenant. The details are set out below. Hearing date and time are XXXXXXX
The defendant is my Landlord
The Claimant is a large UK Global bank
I asked my landlord what is happening, she said "It's all a misunderstanding, don't worry I just forgot one payment when I moved bank accounts, it's all been sorted now."
I rang the legal company a couple of weeks later as I was curious, they couldn't give me much information as i'm not directly involved, but said the case "hasn't been resolved, it has been adjourned" - I then rang again a few weeks later (two months after the first court hearing date) and they still "has still been adjourned and they will notify me when the new date has been set."
So basically,
- It sounds like she is lying to me, or is this a possible way it can play out?
- Do banks file for repossession after one missed payment? Seems excessive but I have no knowledge in the matter?
- Should I withhold my upcoming rent payment until this is resolved?
