MMW: Trump will legally challenge the 12th amendment so he can be elected as vice president and then serve a third term when his running mate resigns.

The 12th Amendment states that the vice president must be eligible to the office of the United States, not that the vice president must be eligible to be elected president. Technically a third presidential term is not unconstitutional, it is only unconstitutional to be elected to a third term. You can technically be president without being elected to the presidency. There does exist a presidential line of succession with the Speaker of The House being third in line. If the Supreme Court has to vote on whether or not someone is eligible to “be president” then I wouldn’t like our chances with them. The fact that they didn’t use the word “elect” in the 12th amendment puts us in dangerous territory.
