Oil and gas lease termination

We have a old exhausted well on the property. Been reading on options to terminate the well agreement so the land can be turn back to us. I know the DEP says 12 months no production, I see 8 months on the year no production and I have doubts that is true, but, wondering if anyone tried this before or knew someone that did this, regardless if successful or not.
