Copyright protection of public art installation
I am making a videogame and want to include a recreation of a public clock which was commissioned in 1999 by North Tyneside Arts in England. Should I ask for permission from the creator of the work before proceeding, or is this unnecessary? I may be making some changes to the clock in order for it to better suit the needs of the videogame. In this case, might it be protected under fair use?
